Abalos To File Libel Against Lozada, Drops “Bombshell” Evidence

Owing to the fact that Former Commission on Elections Chairman Benjamin Abalos is now going on the offensive against star witness to the NBN ZTE scandal Rodolfo Jun Lozada, maybe he should file a libel suit worth the commission that he was supposed to receive. For the trouble that Lozada has caused poor and innocent Abalos, I think the amount of $130 million should suffice.

Abalos, together with his lawyer, announced at a press conference that he would indeed pursue a libel suit against Mr. Lozada for mentioning him in connection to the scrapped broadband deal with Chinese company ZTE. The price however, was only P100 to P200 million, way below the monetary loss that Abalos suffered. Excellent move I guess. And of course, our friend Mr. Abalos has the key to clear his name…

A PIECE OF PAPER!

Abalos Hold Up His Bombshell Evidence

Yes, my dear readers, the bombshell type of evidence is a piece of paper that Abalos says should contradict every single thing that Lozada has to say. In fact, according to Abalos’ logic, we no longer have to listen to anything that Lozada says, because this one fact shatters the Lozada Testimony altogether.

According to Lozada’s testimony at the Senate, he met with Abalos back in September of 2006 where Abalos tried to force an agreement for a loan in the NBN project, which of course included the $130 million. The following day, according to Lozada, a Chinese embassy letter to Malacañang approved the loan.

Now, here’s where Abalos’ secret weapon comes in. Abalos picks up a piece of paper which he says is from the Chinese Ambassador, only that the date was on December 2, 2006.

Because of this, Lozada is no longer credible according to Abalos. And of course, the man behind so many election anomalies is the man we should believe. The man who has denied each and every wrongdoing. But enough of Mr. Abalos’ colorful tenure as COMELEC Chair.

A few things are possible with this statement from Abalos.

1. Abalos is telling the truth, and Lozada is lying
2. Abalos is telling the truth with regards to the letter only, but is still guilty of the crime Lozada has accused him of
3. Abalos is telling the truth with regards to the letter, Lozada was wrong with regards to the date, but the actions of Abalos are still true.
4. Abalos is lying about the letter, the letter is a fake, Lozada’s testimony still holds
5. Both Abalos and Lozada are telling the truth, because there are two letters.

If you choose option 4, and mind you, there are probably more options to choose from, how can Abalos’ letter be a fake?

Here are the steps,

Create a new letter with the date December 2, 2006. Have it signed and endorsed. In any case, after eight hours in front of the Senate, detailed information after another, the burden of proof may be on Lozada. But the burden of credibility for himself is something Mr. Abalos may have to prove first.

So, let’s give Mr. Abalos a hand for his effort. Nice try Mr. former Chair, but I don’t think a mere piece of paper will throw this investigation out the window. As with the fake CDs of the Hello Garci scandal, this low tech scheme doesn’t fool anyone except his own conscience. He has one right?

    But you know how it is with our so-called “justice system”. I mean, will you just look at who our justice secretary is?

  2. Abalos refused to attend the senate investigation. But he was throwing accusations one after the other in media interviews.

    To be fair, the Secretary of Justice, like any other cabinet position, is a political appointment and all too often the chief executive will make sure his/her Cabinet are loyal to him/her. As much as we’d all love to have a non-partisan head of the prosecutorial branch, I don’t think that’s ever going to happen given the nature of the job, which is why safeguarding the independence of the judiciary is critical.

    Secretary of Justice is a political appointment, and the appointee has the right to push the policy of the President, e.g. concentrate on drug cases. But still, aside from that, the department is supposed to be independent, and no marching orders should be made on a case to case basis. Policy or even agenda can be set, but not decisions. Anything further and that vague line is crossed into obstruction. And going even further, even with its Agenda set, it still has the obligation to pursue all illegalities with fervor.

    That’s more of the role of the ombudsman I think. The Constitution lodges the Executive power solely in the President and the Secretaries only act as his/her alter egos – their decisions literally have to be the President’s decisions. Hence the President can legally overrule any decision of his/her Cabinet and can remove them from office at any point. It’s really not possible to have a Cabinet member be independent – unless the President himself/herself gives the particular Secretary that level of freedom. (Not likely) Practically the only thing that a Cabinet member can do that cannot be overruled by the President would be if said member decided to resign.

  10. chairman abalos,dapat pakainin mo ng hambur-JER ang senado bago ka aatend ng hearing para bumait sila sa yo..si neri badingding yan kaya naduduwag pumunta sa senate.ikaw,jun lozada ..ang tigas ng mukha mo…para kang cancer sa bituka ni cory…kalbong intsik!!!!!
